SMS and Text Messaging Terms and Privacy

Program Description

Marcus Naulin ("we," "us," or "our") operates a short message service (SMS) and multimedia message service (MMS) communications program (the "Program") to deliver mortgage rate alerts, real-estate listing updates, transaction status notifications, document-collection reminders, appointment confirmations, customer-service replies, and, where you have opted in, promotional offers. By enrolling in the Program through any web form, paper form, in-person enrollment, telephone enrollment, or text-message keyword (e.g., "START," "JOIN," "YES," or any campaign-specific keyword), you agree to these Terms.

Frequency, Charges, and Carrier Disclosures

  • Frequency. Up to fifteen (15) messages per month per active inquiry; up to four (4) messages per month for general subscribers. Frequency may vary.
  • Charges. Message and data rates may apply per the rate plan with your wireless carrier. We do not charge for the Program itself.
  • Carriers. Supported carriers include AT&T, T-Mobile, Verizon Wireless, U.S. Cellular, Boost Mobile, Cricket Wireless, Metro by T-Mobile, Mint Mobile, Visible, Spectrum Mobile, Xfinity Mobile, and most other U.S. carriers. Carriers are not liable for delayed or undelivered messages.

Opt-Out (STOP)

You may opt out at any time by replying STOP, END, QUIT, CANCEL, UNSUBSCRIBE, or OPTOUT to any message you receive. We will deliver one final confirmation message and cease sending non-transactional messages. Transactional messages reasonably necessary to complete an active loan or real-estate transaction may continue with your separate written authorization or as required to perform our contract with you.

No Sale or Sharing of Mobile Information

Mobile information will not be shared with third parties or affiliates for marketing or promotional purposes. All categories above exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

State-Law Compliance

We comply with the Florida Telephone Solicitation Act (Fla. Stat. § 501.059), the Oklahoma Telephone Solicitation Act, and similar state mini-TCPA statutes, including any prior-written-consent and call-time-window restrictions imposed by those laws. We do not send marketing text messages between 8:00 p.m. and 8:00 a.m. in the recipient's local time except where the recipient's prior express invitation or permission specifies otherwise.

Short Codes and 10DLC Branded Sender

Outbound messages are delivered through CTIA-compliant short codes and Application-to-Person 10-Digit Long Code ("10DLC") campaigns registered with The Campaign Registry. We follow the CTIA Short Code Monitoring Handbook, the Mobile Marketing Association Best Practices, and 10DLC industry guidance.

Non-Liability

To the fullest extent permitted by law, we are not liable for any delayed, undelivered, intercepted, modified, or failed message, or for any data, charge, or fee imposed by any wireless carrier or third-party messaging service.

Privacy

We process the mobile telephone number, content of inbound messages, opt-in records, opt-out records, and message-delivery metadata as Personal Information under our Privacy Policy. We do not sell mobile telephone numbers and do not share them with third parties for marketing.

Changes

We may modify these terms or any campaign at any time. Material changes will be communicated through a Site notice, by email, or by SMS where lawful.
